Following recent court claims in which abuse of process and limitation were considered by the court in a number of its litigated claims.

Overview

A few months earlier, in July 2023, the court found that SSB Law had underestimated the value of a significant number of claims leading to multiple findings of abuse of process.

The Judgment of District Judge Dawson was handed down in July this year (‘the July Judgment’), and was highly critical of SSB Law including its conduct, however the District Judge opted not to penalise the claimants it was representing, by allowing those affected cases to continue albeit, subject to caveats and costs sanctions.

The ultimate fate of these claims is still unclear and clients of SSB Law will no doubt be desperately worried about what will happen to their claims.

Case Study:

In 2019, our client was over 30,000 in debt, to improve his circumstances and after search for a solution to his debt problems he entered an IVA with a large IVA company. The Individual Voluntary Arrangement is a legally binding agreement between an individual and their creditors, providing a structured repayment plan to clear debts over a specified period, in this instance he had an agreement to pay back over £6,000 over 6 years with his creditors agreeing to write off over £25,000 of his debt.

By 2022, after paying into his IVA for 3 years and with his circumstances changing, our client responded to a referral to a solicitor’s practice claiming financial mis-selling and enticing people to pursue a mis-sold IVA claim.  With the advert resonating with him, he was convinced to terminate his IVA prematurely and use his disposable income to buy a report into his situation.

Having lost 3 years of IVA fees due to the termination, with no protection from his creditors, the solicitors practice withdrew from the claim after charging him £550 for the report.

He was left high and dry with his creditors circling.

He then reached out to APJ Solicitors for help.
